Abstract

This paper analyses the position of religion and its religious followers in the constitution and penal code of Afghanistan. Therefore, the constitution of Afghanistan as the most important legal document in the country indicates its base to Believing firmly in Almighty God, adhering to the Holy religion of Islam and declaring the Islamic republic as the political system of the country. The purpose of precision emphasizing on religious values in this constitution is to declare the Holy religion of Islam as the religion of The Islamic Republic of Afghanistan. With this measurement, both the people and state have obligated to observe the provisions of the holy religion of Islam. following and observing the Sharia is the dominative principle and the content of the Constitution must be interpreted according to the provisions of the holy religion of Islam. In addition, the protection of religions and its followers in the constitution and penal code of Afghanistan have been considered into two aspects (acts and beliefs), therefore any kind of threat and attack against religion, religious values, followers of the religion and holy places of the religion have been criminalized.
